Welcome to EchoRiverHome ("we," "us," or "our"). Your usage of our yacht charter services and website at echoriverhome.sbs (the "Service") is subject to these Terms and Conditions ("Terms"), provided by EchoRiverHome.
By securing a booking or using our Service, you consent to comply with these Terms. Should you reject any segment of the terms, you are not permitted access to the Service.
2. Service Overview
EchoRiverHome offers elite yacht charter services, including:
- Day-long yacht rentals
- Evening boat tours
- Business getaways
- Exclusive celebrations
- Extended yachting expeditions
Service availability is contingent on vessel accessibility and meteorological conditions. We maintain the discretion to alter or cease services without prior notification.
3. Booking and Reservations
3.1 Booking Process
Charter reservations require that you:
- Are no younger than 18 years
- Submit valid and thorough details
- Provide the stipulated advance payment as per your reservation confirmation
- Accept these Terms and Conditions
3.2 Confirmation
We only acknowledge bookings upon the successful transaction of your payment and our subsequent written confirmation. Services may be withheld at our prudence.
3.3 Availability
Charter engagements are subject to the vessel's availability and appropriate climate conditions. We'd make efforts to accord with your requested dates and times.
4. Payment Terms
4.1 Pricing
All costs are presented in € and encapsulate applicable duties unless stated otherwise. Pricing is subject to amendment sans prior notice.
4.2 Payment Schedule
- Down payment: 50% of the complete charter fee payable at reservation
- Remaining balance: Payable 48 hours before the charter
- Incidental charges (if any): Due after the charter concludes
4.3 Payment Methods
We support payments via significant credit cards, wire transfers, and endorsed bank checks. All payments are processed through secure, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full reimburse minus transaction fees
- 24-72 hours before departure: 50% reimbursement
- Within 24 hours of departure: No reimbursement
5.2 Weather Cancellations
In cases where our captain decides weather conditions are unsafe, we will propose either:
- A rescheduled charter to an alternate date without additional charges
- A complete reimbursement if rescheduling is unfeasible
5.3 Mechanical Issues
Should your designated vessel encounter mechanical issues, we'll strive to provide an appropriate replacement. If such a replacement isn't available, you will receive a total refund.
6. Safety and Conduct
6.1 Safety Requirements
Passengers must:
- Adhere to all directions from the crew
- Use safety gear as necessitated
- Disclose any health conditions that may impact their security
- Stay within designated regions aboard the vessel
6.2 Prohibited Items
The following are not allowed onboard:
- Containers made of glass
- Illegal items
- Weapons or firearms
- Excessive beverages (beyond moderate consumption)
- Animals (unless permission is granted in advance)
6.3 Conduct
Passenger demeanor must be cordial. Charter services may be canceled without a refund should passenger behavior threaten safety or interrupt the experience for others.
7. Liability and Insurance
7.1 Our Liability
Liability on our part is capped at the charter payment amount made by you. We are not accountable for:
- Injuries sustained due to passenger negligence
- The loss or harm of personal belongings
- Indirect or consequential losses, or penal damages
- Delays attributable to weather or unforeseen control beyond our ability
7.2 Insurance Coverage
Comprehensive marine insurance is in place, covering our vessels and operations. It is your obligation to secure personal travel and insurance coverage.
7.3 Assumption of Risk
Engaging in our yachting services implies an understanding that marine activities carry inherent risks, and you accept personal accountability for your safety and health.
8. Modifications and Itinerary Changes
We retain the right to vary itineraries, courses, or timetables due to weather considerations, safety concerns, or operational necessities. Comparable alternatives will be pursued wherever possible.
9. Force Majeure
Events outside our control, including but not limited to, may lead to delays, cancellations, or changes:
- Drastic climate scenarios
- Catastrophic events naturally occurring
- Mandates from the government
- Port obstructions
- Breakdowns mechanically related
10. Privacy and Data Protection
We manage your personal details as per our Privacy Policy. By engaging with our services, you grant consent for your information to be used as outlined in the Privacy Policy.
11. Intellectual Property
The content on our site, such as text, visuals, trademarks, and pictures, is secured by copyright and trademark legislation. You are prohibited from duplicating, sharing, or creating derivative works without our explicit authorization.
12. Governing Law
The laws of France regulate these Terms, and any disputes shall be settled in the courts situated in Cannes, France.
13. Changes to Terms
These Terms may undergo adjustments at any given time. Updates will be announced on our platform alongside the latest modification date. Continued service usage signifies the adoption of new terms.
